New trial date to be set for Pennfield man charged with attempted murder

Saint John – A 66-year-old Pennfield man charged with attempted murder has been
remanded in custody until Sept. 19 at 1:30 p.m., to confirm that counsel has been retained, and set a trial date.

Brian Harold Smith, who is also charged with aggravated assault, is attempting to obtain new counsel. The charges relate to an incident in Pennfield on April 21, and Smith has been in custody since then.

He has undergone a psychiatric assessment in Campbellton to determine the state of his mental health, and been found fit to stand trial.

The original trial date was set for July 27 and Smith has elected trial by judge alone in Provincial Court without a preliminary hearing. The trial is expected to take one day.
